Talladega County, Ala.

 

            Daniel McMillan as administrator of the estate of Peyton Alford, decd, so far as said decd estate extends in this state of Alabama, Avers and shows unto your Honor that his intestate departed this life in the State of Georgia, leaving a family and heirs at law to his estate as follows, viz: 1st Mary Alford, widow of said Peyton and of lawful age. 2d Andrew J. Alford a minor under the age of 14 years, both residing in Houston County in the state of Georgia, 3d Hinton Alford of lawful age residence unknown. 4 James Alford residing in Monroe County, Georgia. 5 George W. Alford residing in Columbus, Georgia and Pierce Alford residing at Double Bridges [Upson Co.], Georgia.

            Administrator further shows unto your Honor that the said Peyton Alford died seized and possessed of the following lands situate in Talladega County also viz: [land description follows].

            Petitioner further shows unto your Honor that said land is only valuable for the timber, and that the same cannot be equitably _____ divided among the heirs of said decd estate _____ a sale of the same for _____ purpose, that he has been _____ to administer upon said land at the instance of the parties in _____ for the purpose of selling the _____ for division among said heirs.

            Petitioner therefore prays your Honor to set a day for the hearing of this application before your Honor’s court, and that the aforesaid heirs at law may be notified _____ to of the filing of this petition and of the time and place set for the hearing of the same and that your Honor will upon the final hearing of this petition make such orders for the date of the fefore mentioned lands for the purposes specified in this petition, as may be authorized by the proof and _____ law in such case made and provided, and in duty bound your petition will _____.

I have used every effort in my power to enable myself to give you the information you ask me for and I am not able to say whether I am prepared fully or not. When Peyton Alford came to Houston County he brought no family with him whether he had any more children than those whose names I shall give you I cannot find out.

            James Alford, Forsythe, Monroe County, Georgia. George W. Alford, Columbus, Georgia. Pierce Alford, Doublebridges, Georgia. All the above are of full age. Mary Alford, widow of Peyton Alford of full age. Andrew Jackson Alford, seven years old, both of Houston County, Georgia. Inform me if you will have to remit to me what the land sells for or settle with the heirs I have not enough in my hands to pay the debts of this estate. I hope this above will answer your purpose. Anything I can do for you I will most willingly do.
